【工作坊內容摘要】
This paper critically examines the tenability of the individualistic approach to human rights. It argues that while the individualistic thesis does not totally ignore the relational character of human rights, it leads to a warped sense of one’s connections with other people and erroneously regards the human condition as primarily antagonistic and full of conflicts. Against this view, the paper proposes a more robust conception of relationality in human rights. My arguments are twofold: first, human rights are grounded in relationality; and second, human rights structure relations and social identities. Although conflict is part of our relationality, the paper argues that there is little reason to universally endorse a relationality in which conflicts are pervasive. Haphazardly, the paper proposes giving primacy to what can be called “states of peace” in which human relationality is understood as gift exchange.
